terms of service & additional info
it is vital that you read the following in its entirety before commissioning my artwork!
{ ! } notice
the terms of service listed below are important to bear in mind while commissioning my artwork, or purchasing my adopts. these outline permissions, buyers rights, and artists rights as to keep all involved parties safe and happy without strings attached! these are meant to make everything about the process as clear as possible. while they may appear to be a lot to remember at a first glance, much of what is listed is simply common sense, and common decency. they should not be difficult at all to follow, but it is asked that you read through them regardless. by interacting with my work in any shape or form, you are accepting the terms listed below. by extension, you will be held accountable for violating them.
if these are difficult to read within this website, then you can navigate to the button above where the entirety of my tos are stored on a document!
{ i. } purchasing
꩜ all of my commissioned work above $5 is paid half and half rather than within a singular transaction. half of the cost must be paid upfront, and the second must be paid upon the artworks completion. this system is in place as a safety net for both myself and the buyer. you will not receive the unobstructed image until after the second payment. this payment method does not apply to adopts, as these are already completed and must be paid in full before they're given over. the second half of payments is due within 24 hours of a commissions completion. ghosting will result in action.
꩜ the entirety of your payment must be prepared before i begin work on a commission. my time is valuable, and if you must back out during the process due to a lack of funds, that's lost time for me!
꩜ you are not permitted to refuse the second half of payment once your artwork is completed in it's entirety. if this is the result of a poorly-timed emergency, you will not be blacklisted. but as i am unable to determine whether or not its truly a dire mater, or just an excuse for backing out, you will not be permitted to commission me in the near future.
꩜ payment for adopts must be done within 24 hours of requesting purchase. if you do not have the money to purchase an adopt, but will be acquiring that money within the span of a week, then you are permitted to place a hold. if you are unable to pay following this period, then the adopt will be open for others to purchase.
{ ii. } process
꩜ please be polite during the process! i reserve every right to prevent the purchase of an adopt or cancel a commission if the buyer is uncooperative, rude, or demanding. art often takes time, and i have a life outside of it. please be understanding, and please have some respect. i enjoy doing artwork for others, and the joy can very easily be sucked out of it by one bad egg.
꩜ please avoid changing your mind about your request during the process! go in with a clear idea of what you're looking for. dramatic changes often results in wasted time for both of us, and prices tend to differ if your change is particularly significant.
꩜ you're welcome to ask for smaller adjustments and changes during the process! this is your commission, after all! i would love to ensure that it looks how you would like it to. with that in mind, progress will be sent periodically to ensure that you're happy with the turnout. please don't be afraid to communicate, i won't be displeased if your vision is different from what i've drafted up.
꩜ requesting additions that would alter the price of the artwork during the process is not permitted, unless the additional funds are provided at the time of request (i.e., if you are spending 20 dollars total on a commission and take the price up to 30 with an addition, then those 10 extra dollars must be paid right then instead of during the second half of payment.) if you are willing, then this is perfectly fine.
꩜ you as a buyer reserve the right to request progress checks whenever you would like. please understand, however, that there is certainly a line to be drawn between being impatient and being curious.
꩜ your commission will be repurposed if you ghost during the commission process. if you do not respond within 72 hours, i will move onto a different commission. if a week passes without contact, your commission will be considered null. if the absence is a result of emergency, then please reach out. we'll work out a replacement commission (or if nothing has yet be done with your prior commission, then i will resume work on it!)
{ iii. } artwork/design use
꩜ my watermark may not be removed at any point in time, regardless of the reason for doing so.
꩜ do not alter finished products in any shape or form. custom designs or adopts may be given small additions/changes (such as accessories/making additions on locations that cannot be seen in the original design), but only within additional artwork.
꩜ using my artwork for generative ai is not permitted under any circumstances. you will be blacklisted, no questions asked.
꩜ using my designs and artwork for the purpose of spreading bigoted and/or problematic content is not permitted.
꩜ do not trace my artwork, and do not claim my artwork as your own. you're allowed to share the work you commission, but you must provide credit!
꩜ do not post my artwork or designs on pinterest, whether they were commissioned by you or not. pinterest is a cesspool of ai generated content and art theft. it would be disadvantageous not only for me, but for you as well!
꩜ if you purchase an adopt off of toyhouse, please ensure that its profile remains intact. this is how i keep track of design usage.
꩜ you reserve the right to resell an adopt if you grow unattached in the future, but you may not increase the price that the adopt was originally purchased for. if the price is ever lessened during resale, it may not be resold for the original value again. if gifted or traded for non-currency, it loses its value and may only be regifted or traded. however, purchasing artwork of the design can contribute to the value.
꩜ if you're gifting/reselling a design of mine, i must be informed! if the design is stored on toyhouse, then you do not need to contact me, as i will still be capable of tracking who owns the design. if you do not have a toyhouse account, then please reach out to notify me of who the new owner is.
꩜ any artwork that i do not explicitly create for your use is not yours to repost or use without permission. you will be blacklisted without warning if you are specifically caught using my personal characters, or designs that you do not own. they are not yours for the taking.
꩜ you have full permission to use the designs i make as sonas or personal mascots, and by extension, you are permitted to create merchandise of said designs so long as it is not my artwork in particular that is being used! you must own the designs in order to use them in this way.
{ iv. } tos violations
violating my terms of service will result in the following:
꩜ permanent public blacklisting, that of which will be shared with fellow artists in order to keep themselves and their artwork safe.
꩜ forfeit of all rights to the designs and artwork that i have supplied to you. designs of which will be resold to new owners, and artwork of which will be repurposed.
꩜ forfeit of all rights to future designs and artwork, as violators will no longer be permitted to own or receive works created by myself.
꩜ action being taken against your accounts across all platforms.
{ v. } refunds
꩜ i reserve the right to cancel and refund a commission at any given time. refunds in cases such as this will always be in full. cancellations will only be done in one of two cases: personal emergency, or tos violation.
꩜ refunds will not be available to request under any circumstances aside from those in which you're unable to complete the second half of a payment. as i am unable to confirm the honesty of emergency situations, i will be hesitant to complete artwork for you in the future. if a refund due to lack of funds is requested upon an artworks completion rather than before, you will not be permitted to commission me again.
꩜ refunds after a commissions full payment or an adopts purchase will not be granted. chargebacks, by extension, are strictly prohibited.
꩜ all refunded work will be entirely repurposed unless i myself refunded them. canceled commissions are a loss of time and effort, and i have a life outside of commission work. poses/scene layouts/custom designs will be placed up for grabs.
꩜ commissioned work will not be refunded if your rights to my artwork are stripped away due to significant tos violations. action will be taken if you attempt to chargeback. you forfeit your right to a refund once you disrespect my terms.
꩜ you will not receive a refund if you ghost during the commission process. attempting to chargeback without communication is strictly prohibited.
{ vi. } additional information
꩜ toyhouse is important for keeping track of who owns my designs. of course, not everyone has a toyhouse account. with that in mind, i keep adopt batches stored on my own account in the stead of buyers who are off-site. this is something i do require. in these cases, i ask that i am informed of any design transfer so i may make note of who owns specific designs at any given time. toyhouse users may transfer as they please. making characters private is perfectly fine as well, so long as i am informed in the case of transfers that i'm unable to see.
꩜ i may display certain artworks as examples for commissions. if you would prefer that i do not display your commission, then please inform me! i will not at all be offended, and i completely understand.
꩜ i reserve the right to document the purchasing process in case of mishap.
꩜ just as it is my responsibility to handle your personal information wisely, it is your responsibility to offer me the same care.
꩜ below are listed examples of things i will and will not do with 100% certainty.
